Indian pharmaceutical giant Zydus Lifesciences has a lost patent battle with Tokyo-based Astellas Pharma. The US District Court for Delaware upheld the validity of a patent concerning Myrbetriq, a prescription medicine used to treat overactive bladder, in favour of Astellas.

“The Court concludes the Generics Manufacturers (Zydus and Lupin) did not prove their asserted invalidity defences by clear and convincing evidence," the Delaware District Court’s ruling said.

In a regulatory filing to the BSE and NSE dated April 17, 2025, Zydus said, “The Court passed an order in favour of the innovator on the validity of the ‘780 patent. Infringement of the ’780 patent, damages, and any additional invalidity theories will be litigated at a consolidated jury trial in 2026."

Following the legal setback, Zydus Lifesciences shares plummeted nearly 8% on Wednesday.
